Competition Guidelines and Terms



1. Application Process
– All applications must be submitted online through the Youth Direct Competition Landing page website ( https://youthdirect.co.ke ) between the 14th of June to 02nd of July 2021.

– The competition Application Window is 18 days.

– All applicants must complete an application form by answering a series of mandatory questions, and uploading mandatory photos and videos of their agribusiness ventures.

– Personal information supplied in the application form should be verifiable.

– The Applicant must provide current correspondence address, email and telephone numbers and inform in case of any changes.

– Upon submission of the application form, an email confirming the same will be sent to the applicant.

– Once submitted, applications cannot be altered or amended.

– Review of applications will commence immediately after submissions and shortlisting of Applicants will take place following the close of the Application Window on 02nd of July 2021 at 2359 Hrs EAT (11:59 PM)


2. Eligibility
Youth led businesses: 
– Both men and women entrepreneurs working along the agricultural value chain and aged between 18-35 years
– Youth entrepreneurs must lead in their respective ventures and have a minimum shareholding of 51%

Nationality:
– Applicant must be a Kenyan citizen 
– Applicant must be based in Kenya in any of the 47 counties
– Agribusiness venture is operational in any or all of the 47 counties 

Categories of applicants:  
Individuals: Any youth as outlined above involved in a commercially viable venture along the agricultural value chain 
CBO’s and SHG’s: comprising of members who are registered and carrying out a commercially viable business activity within the agricultural value chain with the majority of members (above 51%) as youth (aged between 18-35 years) and main leadership positions being held by the youth
SMEs: Small and Medium Enterprises established and registered and carrying out a commercially viable business activity within the agricultural value chain with the majority of members (above 51%) as youth (aged between 18-35 years) and main leadership positions being held by the youth

Agribusiness ventures:
– Applicants must be engaged in legal business
– All ventures must be agribusiness ideas, or at an early/growth stage and with no specific year range 
– Applicants must demonstrate that the venture is /idea is to be based and operational in Kenya
– Agricultural, fisheries and livestock value chain actors engaged along the value chain are encouraged to apply. This includes but is not limited to input providers, processors, producers, transporters, marketers and aggregators etc.


3. Application Selection
– All applicants will be screened for eligibility and evaluated on a set of criteria whereby a scoring system will be used to provide each applicant with a score of between 0 and 100 (0 lowest to 100 most successful). Criteria on section 4 below

– All applicants will receive an official response on their application determining whether they were successful or not. Producers Direct is not obligated to provide substantive feedback on unsuccessful application

– Applicants will be contacted via email and/or via the preferred contact method indicated in their application.

– Due Diligence shall be carried out on the successful applicants to verify eligibility prior to potential competition prize awarding. Applications that do not meet all or some of the eligibility criteria will not be accepted.

– Communications with the Applicants will primarily be by email, from Producers Direct designated email address to the email address provided by the Applicant on the submission form. Applicants are therefore advised to store Producers Direct contact details in their email address books to avoid the email from being delivered to their spam folder. 


4. Criteria and Scoring System
The following criteria and scoring system will be used for evaluation of the eligible applications for this call.

CRITERIA
Innovation & Commercial Viability:Ingenuity on practical implementation of your idea and feasibility of your business model to compete effectively within the marketplace (30 %)

Scalability: potential for replication and growth of product or service to increase incomes for value chain stakeholders (15%)

Growth Prospect: Entrepreneur or enterprise with potential to adopt and leverage smart approaches to drive the growth of the agribusiness (15 %)

Social Impact:An enterprise with the potential to have positive effect on global/local environment while addressing environmental and social issues, includingpotential to create decent employment opportunitiesfor youth and women (20%)

Sustainability and Market Potential:Capacity to provide market opportunities along agricultural, fisheries andlivestock value chains and customers for theagribusiness idea/Agribusiness to scale (20%)


5. Terms and Conditions
– Successful Applicants shall be subject to the stated terms and conditions, and other rules and guidelines published by Producers Direct from time to time for the running of the Youth Direct campaign and competition

– Producers Direct and its program affiliates reserves the right to cancel or amend all or any part of the Rules without notice. Any changes to the Rules will be posted on Producers Direct Youth Website (https://youthdirect.co.ke). It is the responsibility of Successful Applicants to keep themselves informed as to any changes to the Rules. Producers Direct shall not be liable for any loss suffered by a Successful Applicant due to any changes to the Rules, including failure to complete some or all tasks under the program due to such change.

– If for any reason the program is not capable of running as planned for reasons including but not limited to tampering, unauthorized intervention, fraud, technical failures, force majeure events or any other causes beyond the control of Producers Direct and its funding partners which corrupt or affect the administration, security, fairness, integrity or proper conduct of this program, Producers Direct reserves the right to cancel, terminate, modify or suspend the program and disqualify any Successful Applicant.

– Producers Direct shall not be liable for any loss arising from modification, suspension, or cancellation of the program.


6. Ineligibility/Disclosure of Conflict of Interest
Employees from either Producers Direct or affiliated partners in the Youth Direct campaign and their immediate family members are not eligible to apply for the program, either individually or as part of a team or entity. 


7. Privacy Policy
– By applying to the Youth Direct competition, Applicants consent to have details of their Application – other than commercially sensitive information – featured in any media or promotional activity for the Youth Direct campaign being carried. 

– Producers Direct will contact Applicants in advance of any media request for interviews. 

– Producers Direct and affiliated partners/hubs will only use the personal details supplied for the administration of the competition and Youth Direct na Agribiz Campaign, and for no other purpose except with the Applicant’s consent. 

– Judges will be required to sign a non- disclosure agreement as it relates to personal information which may come into their possession during the Youth Direct campaign and competition


8. Fraud, Bribery and Corruption
Producers Direct is completely against fraud, bribery and corruption. Producers Direct does not ask for money for applications or proposals. 

If approached for money or other favours, or if you have any suspicions of attempted fraud, bribery or corruption please report immediately and provide as much detail as possible with any reports. Likewise, if any fraud, bribery, or corruption during the call process is discovered, Producers Direct reserves the right to terminate the cooperation with the individual or agribusiness in question.

Producers Direct is committed to protecting and respecting your privacy.

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully.

Information we may collect from you

We may collect and process the following data about you:

Information you give us. You may give us information about you on our websites (youthdirect.co.ke or producersdirect.org) or via the interactive features of our website, platform and services (“our site”), or by corresponding with us by phone, SMS, e-mail or otherwise. This includes information you provide when you register to use our site, subscribe to our service, participate in discussion boards or other social functions, apply for a job, send us a query on our site and when you report a problem with our site.

The information you give us may include your name, country of residence, gender, date of birth, email address, phone number and descriptions of your expertise and preferences.

Information we collect about you. With regard to each of your visits to our site we may automatically collect technical information (including the IP address used to connect your computer to the internet, your login information, browser type and version, time zone setting, operating system and platform), or other information about your visit (including the URL clickstream to, through and from our site (including date and time), download errors, length of visits to certain pages and page interaction information.

Uses made of the information

We use information held about you in the following ways:

Information you give to us. We will use this information:

  • in anticipation of or accordance with the terms and conditions on our website; or
  • where it is necessary for our legitimate interests (or those of a third party) in the operation of our business and we have made an objective assessment that your interests and fundamental rights do not override those interests, for example:

    • to improve the service that we offer;

  • to administer our site and for internal operations, including troubleshooting, data analysis, testing,
  • research, statistical and survey purposes;
  • to improve our site to ensure that content is presented in the most effective manner for you;
  • as part of our efforts to keep our site safe and secure;
  • to measure or understand the effectiveness of advertising we serve to you and others,
  • and to deliver relevant advertising to you.

Disclosure of your information

We may share your information with selected third parties including:

  • business partners, suppliers and sub-contractors for the performance of any contract we enter into with them;
  • advertisers that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users. We may also use such aggregate information to help advertisers reach the kind of audience they want to target;
  • analytics and search engine providers that assist us in the improvement and optimisation of our site.

We may disclose your personal information to third parties in the event that we sell or buy any business or assets (in which case we may disclose your personal data to the prospective seller or buyer of such business or assets), or in instances where we are under a duty to disclose or share your personal data in order to comply with any legal obligation or in order to enforce or apply our terms of use.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law.

We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Transfer of your data

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring that either:

  • we have a specific contract with that processor in a form approved by the European Commission which ensures that service provider gives your personal data the same protection it has in Europe; or
  • if the provider is based in the US, it is a member of the US Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US; or
  • the processing is necessary in anticipation of or in order to perform a contract to which you are a party or in your interest.

Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long will you use my personal data for?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.  

Your legal rights

You have the right in certain circumstances to:

  • Request access to your personal data (a “data subject access request”).
  • Request correction of the personal data that we hold about you.
  • Request erasure of your personal data.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.
  • Request restriction of processing of your personal data.
  • Request the transfer of your personal data to you or to a third party.

  • You will not have to pay a fee to access your personal data (or to exercise any of the other rights).
  • We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.  We may also contact you to ask you for further information in relation to your request to speed up our response.
  • We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
